TERMS AND CONDITIONS OF SALE OF THE KRAZY STONES WEBSITE

ARTICLE 1 – ENTIRE AGREEMENT

These general terms and conditions constitute the entire agreement between the parties. In this regard, the buyer is deemed to accept them without reservation.

The seller, SARL Barrouyer Joaillerie, located at 71 Rue de L'Évéché, 84200 Carpentras, and the buyer agree that these general terms and conditions exclusively govern their relationship. The seller reserves the right to modify these terms occasionally. They will be applicable as soon as they are published online.

If any sales condition is missing, it shall be deemed to be governed by the current practices in the distance selling sector in which companies have their headquarters in France.

ARTICLE 2 – PURPOSE

These general terms and conditions define the rights and obligations of the parties in the context of online sales of goods and/or services offered by the seller to the buyer.

ARTICLE 3 – ORDER PLACEMENT

The buyer can place an order online using the online catalog and the provided order form.

To validate the order, the buyer must accept these general terms and conditions by clicking in the designated area. They must also choose the delivery address and method and confirm the payment method.

In certain cases, such as non-payment, incorrect address, or other issues with the buyer’s account, the seller reserves the right to block the order until the issue is resolved.

If a product is unavailable, the buyer will be informed by email.

ARTICLE 4 – ELECTRONIC SIGNATURE

Providing the buyer's credit card number online and the final validation of the order will constitute proof of the buyer’s agreement under the provisions of the law of March 13, 2000, and will constitute:

  • Enforceability of the sums due under the purchase order,
  • Signature and express acceptance of all transactions carried out.

ARTICLE 5 – ORDER CONFIRMATION

The seller provides the buyer with a copy of the contract, either on paper signed by both parties or, with the buyer's agreement, on another durable medium confirming the express commitment of the parties.

ARTICLE 6 – PRODUCT INFORMATION

The products governed by these general terms are those listed on the seller's website and indicated as sold and shipped by the seller. They are offered within the limits of available stock.

Products are described and presented with the greatest possible accuracy. However, if errors or omissions occur in this presentation, the seller cannot be held liable.

ARTICLE 7 – PRICES

The seller reserves the right to change its prices at any time but agrees to apply the rates in effect at the time of order placement, subject to availability.

Prices are indicated in euros and include VAT applicable on the date of the order.

ARTICLE 8 – PAYMENT METHOD

This is an order with an obligation to pay, meaning that placing an order requires the buyer to complete payment.

ARTICLE 9 – PRODUCT AVAILABILITY – REFUNDS

If the ordered product is unavailable, the buyer will be informed as soon as possible and will have the option to cancel the order.

ARTICLE 10 – DELIVERY TERMS

Delivery is only made after confirmation of payment by the seller’s banking institution.

Ordered products are delivered by Colissimo or an independent carrier.

ARTICLE 11 – DELIVERY ERRORS

The buyer must notify the seller of any delivery errors and/or non-conformity of the products in terms of nature or quality.

ARTICLE 12 – PRODUCT WARRANTY

SARL Barrouyer Joaillerie guarantees the conformity of the goods with the contract.

ARTICLE 13 – RIGHT OF WITHDRAWAL

Under the provisions of the Consumer Code, the buyer has a period of **14 working days** to exercise the right of withdrawal.

ARTICLE 14 – RETURN PROCEDURE – REFUNDS

After communicating the decision to withdraw, the buyer has **14 days** to return the goods.

ARTICLE 15 – FORCE MAJEURE

Any circumstances beyond the control of the parties that prevent the execution of their obligations under normal conditions shall be considered grounds for exemption.

ARTICLE 16 – MEDIATION

Under articles L612-1 and following of the Consumer Code, a mediator can be contacted in case of disputes.

ARTICLE 17 – APPLICABLE LAW – DISPUTE RESOLUTION

These general terms and conditions are subject to **French law**.
